How Many Units Can You Build on a Kelowna Lot?

Kelowna's RU1, RU2 and RU3 zones allow up to 4 units. Unlike most Bill 44 cities, an unconfirmed servicing check does not cap your lot here: only a confirmed absence of a sewer connection does.

Kelowna runs Zoning Bylaw No. 12375, and its small-scale entitlement sits in the RU1, RU2 and RU3 residential zones: RU1 (Large Lot Housing), RU2 (Medium Lot Housing) and RU3 (Small Lot Housing) all permit up to 4 dwelling units, including townhouses and stacked townhouses, not just a duplex.

The bylaw does gate that count on servicing (s.11.3: more than 1 unit needs community water, more than 2 needs community sewer), but Kelowna reads the gate the opposite way from most BC cities that publish no connection records. Community water is assumed for every lot. Sewer is assumed too, unless the City's own infrastructure layer can positively confirm no sewer lateral or stub sits within 35 m of the lot. An inconclusive check does not lower the count here; only a confirmed negative does.

Why Kelowna's servicing gate runs backwards from most cities

Most BC municipalities in this position hold an unconfirmed lot at a conservative lower number until servicing is proven. Kelowna does the opposite for sewer, because a failed or inconclusive lookup against the City's sanitary lateral and stub layer keeps the full unit count rather than reducing it. Only an explicit finding of no sewer line within 35 metres caps a lot at 2 units.

In practice this means most RU1, RU2 and RU3 lots reach 4 units, with a minority, those the City's own infrastructure layer can positively show have no nearby sewer, held to 2.

RU1, RU2 and RU3: lot size is what differs

All three permit single detached, semi-detached, duplex, townhouse and stacked townhouse housing, and all three share the same 11 m / 3-storey / 40% coverage envelope. Look up your address for the exact minimum area and frontage your specific lot needs to clear.

MF1, MF4 and RU5 are different tracks, not a higher SSMUH tier

Kelowna has other zones that permit more than 4 units, but they are not part of the small-scale ladder and a lot does not move between them by right. MF1 Infill Housing allows up to 6 units under its own ground-oriented rules. MF4 sits inside Transit-Oriented Areas and follows the City's own pre-zoning, generally 6 storeys and a 2.5 floor area ratio, which is a separate provincial density track, not a Bill 44 unit count. RU5 Multiple Suburban Housing sets its density as a rate, 9 dwelling units per 1,000 m² of lot area, rather than a fixed per-lot number, so what it works out to depends on your lot's exact size.

If your address is zoned MF1, MF4 or RU5, look it up directly rather than assuming the RU1-RU3 figures on this page apply.

All three run to 11 m and 3 storeys at 40% site coverage. What differs between them is minimum lot size, not the unit count or the envelope.

Kelowna Bill 44 FAQ

How many units can I build on my lot in Kelowna?

Up to 4 dwelling units in the RU1, RU2 and RU3 zones. Community water is assumed and only a confirmed absence of a sewer connection within 35 m of the lot lowers that to 2.

Does an unconfirmed sewer connection lower my Kelowna unit count?

No. Kelowna's servicing check defaults to the full count unless the City's sanitary infrastructure layer can positively confirm no lateral or stub sits within 35 m of the lot. That is different from most BC cities on this point, so do not assume an unverified result means a lower number.

What is the difference between RU1, RU2 and RU3 in Kelowna?

Minimum lot size. RU1 (Large Lot Housing) needs the biggest lot, RU2 (Medium Lot Housing) sits in between, and RU3 (Small Lot Housing) has the smallest minimum. All three allow the same unit count, height, storeys and site coverage.

Can I build townhouses under Kelowna's small-scale zoning?

Yes. RU1, RU2 and RU3 all list townhouses and stacked townhouses among their permitted uses alongside single detached, semi-detached and duplex housing, so the 4-unit entitlement is not limited to a duplex.

Does Kelowna have a 6-unit transit tier?

No. Kelowna's "Frequent Transit Lots" designation reduces parking requirements only. There is no published prescribed-stop list and no 6-unit small-scale band in the bylaw.

What does MF1, MF4 or RU5 zoning mean for unit count in Kelowna?

These are separate tracks, not a higher small-scale tier. MF1 (Infill Housing) allows up to 6 units under its own rules. MF4 sits in Transit-Oriented Areas and follows the City's own density pre-zoning. RU5 (Multiple Suburban Housing) sets a density rate, 9 units per 1,000 m², rather than a fixed count. Look up your address directly if it carries one of these zones.
